According to Article 118 of the Icelandic Bankruptcy Act, a claim against bankruptcy estate shall be cancelled with respect to the estate, if it is not stated to the trustee in bankruptcy before the period provided for in Article 85, the second paragraph, is over, and if it cannot be pursued as provided for in Article 116, unless the exceptions in Points 1-6 of Article 118 are applicable, cf. Point 1;
1. the claim is stated before a meeting of the creditors is convened for considering a proposal for distribution, and its acceptance is approved by three fourths of the creditors who would not be paid as a result, both by number of creditors and the amounts of their claims.
In other words; a party wishing for his claim to be accepted by the Winding-up Committee of Kaupthing Bank hf., has to obtain an approval from æ of the creditors who would not be paid as a result, both by number of creditors and the amounts of their claims.
On the whole it is not the Winding-up Committee¥s obligations obtaining above-mentioned approval from the creditors. It is solely in the hands of those parties wishing to have their claims accepted.
It is foreseeable that the creditorsí meeting on 3 December 2010 will not be competent to resolve matters such as accepting your claim.
